1. General 

By entering and using this website, you agree to all of the terms and conditions as set out below. Vicky Coffee reserves the right to change the terms & conditions at any time.

This website is for use by persons located and resident within the Malta and EU countries. Accordingly, these terms and conditions shall be subject to Maltese law and the parties to any dispute or action hereby submit to the exclusive jurisdiction of the Maltese courts.

We want the coffee to arrive with you as fresh as possible. With that in mind, we process our orders daily, excluding Sundays and Public Holidays. If you order after 6:00 am on Saturday then it will be processed the following Monday.

2. Pricing

All prices quoted in EUR including VAT in this website were correct at the time of publication but errors and omissions are excepted. Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed may be incorrectly priced and we apologise if any offer is incorrect. Please advise us if this is the case and we will correct any errors without delay.

2.1 Offers 

Percentage discount codes are allocated for one time use per customer. If not specifically defined, these cannot be used on subscriptions or Gift Cards and cannot be used in conjunction with any other discount/offer. Please note all offers are strictly subject to availability and acceptance by Vicky Coffee and nothing in this website constitutes or implies a contract of sale unless confirmed in writing by an authorised representative of Vicky Coffee. All and any offers may be withdrawn without notice entirely at the discretion of Vicky Coffee.

2.2 Free Samples 

On occasion we may include a free sample coffee in your delivery as a little present. Please let us know by adding a note to your order if you do not wish to receive free samples. Free samples may be added to your order at the discretion of Vicky Coffee or as a part of a promotional campaign. Vicky Coffee is not obliged to include free samples to the order.

3. Subscription Plans

You may choose to subscribe to a subscription plan through the service. The subscription plan consists of an initial charge followed by recurring periodic charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and that you accept responsibility for all recurring charges prior to cancellation.

We will submit periodic charges (e.g., fortnightly and four weekly) without further authorization from you, until you opt out of auto-renewal on your account page by using the “Cancel Subscription” button. The week that you order in is the first fortnight or four weekly box edition that you will receive. We try to dispatch all of our boxes within 1-3 working days after receipt of order.

The initial payment for your Vicky Coffee box will be withdrawn at the time of checkout. For subsequent boxes/terms, payments are automatically scheduled to withdraw at your chosen rate of delivery (two weeks or four weeks) from your sign up date.

You are entitled to cancel your subscription at any time, however please alert us as soon as possible if you would like to cancel your subscription on info@vicky.coffee.

Promotional codes/discounts are only valid on the initial order, not the recurring charges, unless otherwise noted.

We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.

4. Delivery

Our standard delivery cost across all Malta and Gozo is EUR (2.00 + 0.50 multiplied by the quantity of items) per delivery. For example, if you order three items, the delivery cost will be EUR (2.00 + 0.50 x 3) = EUR 3.50 per delivery. Your order will be processed as standard priority and we will send you an email when it is dispatched. Your order will be delivered with our delivery provider of choice within 1-3 working days from dispatch date. Please note that since deliveries are carried out by a third-party service provider, some circumstances are out of our control.

4.1 Local Collection

If you would like to collect your order in person and save on delivery fees, please select the ‘Pick Up’ option when checking out. Your order will be processed as normal within 1-2 working days and we will send you an email when and where to be collect your order.

4.2 EU Delivery Charges

Items will be posted to the shipping address received during the checkout process. All orders will be delivered by a third-party provider of our choice. Delivery time and cost of delivery will be quoted during the ordering process.

4.3 International Delivery (Non- EU)

Vicky Coffee does currently not ship the products outside the EU. If you wish to request further information kindly contact our team on info@vicky.coffee.

5. Returns & Refunds 

Coffee is a perishable product, so we’re unable to accept returns on your coffee order. However, we want you to be happy with your purchase!  Please don’t hesitate to reach out to our orders support team within 14 days of purchase by emailing us at info@vicky.coffee – we may be able to offer you an exchange or recommend another product that suits you better.

5.1 Damaged Or Incorrect Orders 

If for any reason your order is incorrect or damaged then Vicky Coffee will offer a replacement or refund, please contact us to review the case and arrange the return of the goods. 

If goods are returned due to being faulty, so long as they are returned within a reasonable time the remedy afforded to the customer, under the Sale of Goods Act 1979 (as amended), is a refund or replacement as per preference of the customer. In this case, the carriage charge for return of the goods is handled by Vicky Coffee. 

5.2 Change Of Mind 

Where a consumer exercises his/her cancellation rights, the customer will be given a refund within 14 days of their cancellation. The cancellation period ends on the expiry of seven working days, commencing on the day following the day on which you, the customer, receives the goods. Roasted coffee and custom orders are excluded from these terms. Goods must be returned in their original, un-damaged packaging.

If you have changed your mind and the items are unsuitable then please contact us within 14 days of receipt of the goods to arrange a refund. You will incur the carriage charge for return of the goods. Please note that refunds are subject to the provided goods being in perfect, unused and complete in their unopened original packaging. Please allow 14 working days for this process. We recommend that your carrier provides you with ‘proof of delivery’ as Vicky Coffee cannot be held responsible for goods lost or damaged in transit. 

6. Complaint Handling 

We will in every case acknowledge complaints within 5 working days. We will ensure that in every case the customer is advised throughout the whole procedure.

7. No Warranty

The website, products and materials are provided on an “as is” and “as available” basis. Use of the website is at your own risk. To the maximum extent permitted by applicable law, the website, products and materials are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. No advice or information, whether oral or written, obtained by you from Vicky Coffee or through the website will create any warranty not expressly stated herein.

Without limiting the foregoing, Vicky Coffee do not warrant that the content is accurate, reliable or correct; that the website will meet your requirements; that the website will be available at any particular time or location, uninterrupted or secure; or that the website is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the website is downloaded at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from such download or your use of the website. Vicky Coffee does not warrant, endorse, guarantee, or assume or accept any responsibility or liability for access to or material on, any website that is linked from or to this website.

8. Disclaimer & Liability 

All express warranties, representations, conditions of any kind or other terms implied by statute or common law of Malta with respect to this web site or the information, content, materials or products included on this web site are hereby expressly excluded to the fullest extent permitted by law.

Vicky Coffee shall not be liable in any circumstances for any direct or indirect, special or consequential loss or damage (whether for profit or loss or otherwise) costs, claims, expenses or other claims for compensation what so ever, whether caused by the acts, its employees or agents, which arise out of or in connection with the use of this web site or the information, content materials or products included on this website, except in respect of death or personal injury caused by Vicky Coffee, its employees’ or its agents’ proven negligence.

Views expressed in user generated content on other web sites (including such content posted on other web sites using this web site or any tool available through it) are the views of the author alone, are not the views of Vicky Coffee unless expressly stated otherwise and are not endorsed by Vicky Coffee.
